A lawsuit against RGS Financial over alleged violations of the Fair Debt Collection Practices Act was granted class status by the U.S. District Court for the Northern District of Illinois on the condition that the lead plaintiff amends his retainer agreement with his lawyer.
The retainer agreement provides that Gabriel Tataru is “on the hook for attorney’s fees if he accepts a settlement against the advice of his counsel,” Judge John J. Tharp Jr. said.
