Red Baron Pizza ‘Preservative-Free’ Deception Suit Advances

Red Baron pizza manufacturer SFC Global Supply Chain Inc. must face a proposed class action alleging it misleadingly portrays its fare as having a “preservative free crust,” an Illinois federal court said, finding the plaintiffs’ second attempt plausibly alleged this part of the label was deceptive.

But plaintiffs Jamie Jackson and Trenton McDonald again failed to support claims that the labeling misleadingly said several frozen pizza offerings contain “no artificial flavors,” the U.S. District Court for the Southern District of Illinois held. However, they may amend their complaint, it said Wednesday.
