RAZE Energy Drink Labeling Suit Tossed for Lack of Jurisdiction

An energy drink labeling class action fails to meet the requirements for federal jurisdiction, the Middle District of Florida held.

The court took it upon itself to raise concerns that the suit didn’t satisfy the Class Action Fairness Act’s diversity and amount in controversy provisions.

Matthew C. Ringsmuth sued Repp Sports LLC, alleging unfair marketing, breach of warranty, and unjust enrichment over the nutritional content of its RAZE energy drinks. He used CAFA as the basis for filing in federal court.

But his allegations fall short, the court said Oct. 23.
