Quincy Bioscience LLC must face class claims that it made misleading claims about three of its brain health supplements, a federal court ruled Dec. 15.
Everyone who purchased Quincy’s Prevagen products would have been exposed to the same brain health claims that appeared on the labels, Judge Haywood S. Gilliam Jr. wrote for the U.S. District Court for the Northern District of California.
Common questions and common evidence about the falsity of Quincy’s statements make class certification appropriate, the court said.
