Northeastern U. Students Can Proceed With Covid-19 Refund Suit

Northeastern University can partly evade a proposed class action filed by students in connection with Covid-19 closures after a federal court in Massachusetts dismissed claims linked to some student activity fees.

Students filed their lawsuit in the U.S. District Court for the District of Massachusetts after the private university in Boston canceled all in-person classes and suspended access to on-campus resources in March. The complaint alleges breach of an express contract, breach of an implied contract, and unjust enrichment.

The students are seeking a tuition refund, and that claim survived the university’s motion to dismiss.
