No Class Discovery for Lockheed Martin Workers in Race Bias Suit

Black Lockheed Martin Corp. employees who sued the company for alleged racial discrimination in its performance evaluation system aren’t entitled to class discovery because they didn’t adequately allege classwide injury and relief, the U.S. District Court for the District of Columbia held Tuesday.

The workers, pursuing disparate treatment and disparate impact discrimination claims, asked the court for six months of fact discovery and five months of expert discovery.

But the proposed class failed to establish that pre-certification discovery could cure the defects in their second amended complaint, the court said.
