Navient Avoids Student Loan Debt Practices Class Suit

Navient Corp. and two other companies beat back a proposed nationwide class action brought by a student-loan borrower who alleges their debt-collection practices have forced her to continue making payments on paid-off loans to avoid garnishment and a negative credit rating.

A Consumer Financial Protection Bureau database containing 5,000-plus complaints lodged against Navient offers some evidence of common issues, but there’s no way to prove the claims on a classwide basis without delving into each person’s specific experience, Judge Holly L. Teeter of the U.S. District Court for the District of Kansas said Tuesday.
