National Spine and Pain Centers LLC won’t have to face a proposed class action over unsolicited faxes it sent to chriopractors during the Covid-19 pandemic encouraging them to make telemedicine appointments to keep patients out of hospital emergency rooms.
Plaintiff Scoma Chiropractic PA failed to show that either of the classes it proposed satisfied the requirement that issues common to class members predominate over issues requiring individualized proof, nor that a class action was superior to other methods of adjudicating the dispute, Judge John L. Badalamenti of the US District Court for the Middle District of Florida said Thursday.
