Merchants Leasing Credit Card Machines Proceed as Class

Merchants alleging the companies who lease credit card processing equipment conspired to defraud them were properly granted class status, the Ninth Circuit affirmed Feb. 7 (Just Film Inc. v. Buono, 2017 BL 36265, 9th Cir., No. 14-16132, 2/7/17).

Decertifying the two classes of merchants would likely have ended the case, as the merchants’ financial injuries weren’t large enough to pursue individually.

The classes are comprised of small businesses who allege the leasing defendants violated the Racketeer Influenced and Corrupt Organizations Act, the Fair Credit Reporting Act and various state laws.
