Lemon Is Flavor, Not Ingredient, Court Says in Urging Dismissal

“Lemon Snaps” labeling reflects the flavor of the cookies, not a particular ingredient, a federal magistrate judge said, recommending dismissal of a proposed class false-ad suit against D.F. Stauffer Biscuit Co.

Gilberto Cruz and Norma Melendez alleged that the cookies’ packaging misleads consumers into thinking the flavor comes only from lemons, but scientific testing has shown that the product contains only a trace amount of real lemon.
