Kohl’s Pricing Settlement Stands; Fees Need Another Look

A $6.5 million settlement to compensate Kohl’s Department Store customers allegedly deceived by “compare at” pricing is fair to class members, the U.S. Court of Appeals for the Ninth Circuit affirmed Nov. 5 in an unpublished opinion.

Customers will receive $10 in e-credit to use at the store under the deal. The credits don’t trouble the court because they are “transferrable, stackable, usable with other Kohl’s promotions, and large enough to allow class members to buy more than 1750 items from Kohl’s without spending their own money,” the court said.
