Keurig Coffee Pod Knockoff Suit Wins Class Certification

Buyers of Grove Square Coffee pods marketed for use in Keurig coffeemakers won class certification in their suit alleging they were deceived into thinking the product inside was premium, ground coffee when it was really instant (Suchanek v. Sturm Foods Inc., 2015 BL 361846, S.D. Ill., 11-00565, 11/3/15).

The liability question, whether the packaging was likely to mislead a reasonable consumer, is common to each class member’s claim, Judge Nancy J. Rosenstengel of the U.S. District Court for the Southern District of Illinois said Nov. 3.
