Kellogg to Pay $1.8 Million to Resolve FLSA Overtime Claims

Kellogg Co. will pay $1.8 million to settle claims that it failed to pay overtime to sales representatives under an agreement given preliminary approval by the Western District of Michigan.

The agreement will resolve the claims of the three named plaintiffs—Roseann Miracola, Scotty Poarch and Mark Young—74 opt-in plaintiffs, and any of about 1,700 Fair Labor Standards Act collective members who opt into the settlement.

About $1.1 million of the total award will be allocated to the named and opt-in plaintiffs. The remainder of the fund, approximately $687,200 is allocated to the FLSA collective members.
