Insurer Off the Hook for Apartment Complex Contamination Claims

Cincinnati Insurance Co. is off the hook for costs related to toxic chemical contamination at an apartment complex in Peoria, Ariz.

Insurance coverage wasn’t triggered because there was no suit involving Thompson Thrift Development Inc. and Watermark at Peoria AZ LLC, which owned and managed the complex, the US District Court for the Southern District of Indiana said in a Tuesday order.

According to the order, Thompson learned of the contamination in 2022, after environmental sampling showed a high concentration of the toxin perchloroethylene.
