Midwestern grocery, gas, and restaurant chain Hy-Vee Inc.'s settlement offer to consumers for expenses due to a credit card data breach at its stores merits preliminary approval, a federal court in Illinois ruled.
The deal provides for a per-consumer cap of $225 for a variety of out-of-pocket expenses and lost time, as well as reimbursement of “extraordinary” expenses up to $5,000 per claimant with proof that the loss couldn’t be reimbursed through another channel.
Judge Michael M. Mihm of the U.S. District Court for the Central District of Illinois Monday also provisionally approved the settlement class.
