Houston Astros Beat Season Ticket Holders’ Sign-Stealing Claims

The Houston Astros baseball team won dismissal Thursday of class action claims that it sold season tickets under false pretenses while engaging in a sign stealing scheme that violated MLB rules.

The allegations fail because claims based on how a sports team plays the game are not “cognizable,” the Texas Court of Appeals for the 14th Circuit said.

The plaintiffs’ claims arose from the way the Astros “played the game and the plaintiffs’ ‘embarrassment, disappointment, shame, and disgrace’ of the sign-stealing scandal despite their attempts to couch their claims in terms of off-the-field misrepresentations,” the court said.
