Home Depot Fights Off California Workers’ Waiting-Time Claim

Home Depot USA Inc. defeated a claim in a wage-and-hour suit because the current named plaintiff lacks standing to sue and a new one’s claim is outside the statute of limitations, a federal judge in California said.

John Utne accused the home improvement chain of multiple state labor law violations and later left his job. He can’t pursue a claim for failure to timely pay final wages because he still worked for Home Depot when he sued, the US District Court for the Northern District of California said.
