Home Depot Can’t Send Consumer Suit to Federal Court

Home Depot USA Inc. must face another consumer class action over misleading sales tactics in state court, the Fourth Circuit held Jan. 22.

The company’s position in the case doesn’t allow it to invoke federal jurisdiction, Judge Allyson K. Duncan wrote for the U.S. Court of Appeals for the Fourth Circuit.

The Seventh Circuit came to a similar conclusion in a related suit against Home Depot in 2017.
