Hillshire Brands Must Face Jimmy Dean Sandwich False-Ad Claims

Hillshire Brands Co. must face claims that it duped consumers into thinking certain Jimmy Dean brand English muffin breakfast sandwiches are predominantly whole grain, a federal court in New York said, focusing on the label’s “made with” phrase.

Christopher Wargo challenged the packaging of Delights English Muffin turkey sausage, egg white, and cheese breakfast sandwiches. The front label says the muffins are “MADE WITH WHOLE GRAIN,” but their main ingredient is enriched wheat flour, which doesn’t contain fiber or other nutrients that are present in whole grains, he said.
