Female athletes at a Hawaii high school won another chance Monday to pursue Title IX sex bias claims as a class, when the Ninth Circuit said they met the initial showing that the proposed class is large enough to warrant certification.
The students also met Rule 23(a)'s threshold requirements on their claim that school administrators retaliated against them for raising Title IX compliance concerns, the U.S. Court of Appeals for the Ninth Circuit said.
