Haleon Is Stuck With Proposed False Cookie Banner Class Lawsuit

Haleon US Inc. failed to convince a federal court to dismiss most of a lawsuit over its alleged use of online trackers even when website visitors tried to disable them.

Plaintiff Jonathan Gabrielli said he indicated through a pop-up cookie banner that he’d reject online trackers, but the website failed to disable the third-party software. If true, the allegations that “Haleon deprived him control of personal information regarding his digital activity and profile” are sufficient to assert standing, Judge William H. Orrick of the US District Court for the Northern District of California said Aug. 29.
