Getty Images Gets to Arbitrate Claims It Licensed Public Content

A federal court granted Getty Images’ motion to dismiss a proposed class action alleging that it improperly charges licensing fees for images in the public domain.

And the plaintiff, Cixxfive Concepts LLC, a Texas-based digital marketing company, will have to pursue its individual claims in arbitration, the U.S. District Court for the Western District of Washington ruled Tuesday.

Cixxfive had reasonable notice of the terms of the content licensing agreement and agreed to the arbitration clause when it completed the transaction involving the disputed image, Judge Robert S. Lasnik found.
