Genworth Keeps Senior Financial Abuse Class Action Federal

Genworth Life & Annuity Insurance Co. convinced a federal court Jan. 23 that a class action alleging it committed financial senior abuse shouldn’t go back to state court.

The seniors’ allegations put more than $5 million at issue, making federal jurisdiction appropriate under the Class Action Fairness Act, Judge Lawrence J. O’Neill wrote for the U.S. District Court for the Eastern District of California.

The court also dismissed the case as untimely but gave the seniors 14 days to amend the complaint.
