General Mills ‘No Artificial Flavors’ Fruit Snack Suit Dropped

General Mills Inc. and a consumer alleging it hides the presence of artificial flavors in “Fruit by the Foot,” “Gushers,” and “Fruit Roll-ups” snacks have stipulated to the dismissal of his individual claims, according to a federal court filing.

David Hayes alleged General Mills deceived consumers and violated federal regulations by labeling the snacks as having “no artificial flavors” despite the presence of malic acid, which he said makes them taste tart and combines with sugar to simulate a fruit flavor.

In General Mills’ view, however, the malic acid functions as a flavor enhancer, but not a flavor.
