General Mills Cereal Buyers Drop Appeal in Sugar Deception Suit

General Mills cereal buyers voluntarily dropped an appeal that asked the Ninth Circuit to reinstate a would-be class suit alleging the company deceptively marketed some products with wellness claims that are misleading because of their high sugar content.

Beverly Truxel and Stephen Hadley alleged General Mills Sales Inc. misleadingly marketed Cheerios, Chex, and other cereals.

The U.S. District Court for the Northern District of California dismissed the suit for good last year, throwing out what was the plaintiffs’ fourth attempt to state viable claims.
