The company sufficiently alleged that the amount in controversy will surpass the Class Action Fairness Act’s $5 million threshold for federal jurisdiction, the U.S. Court of Appeals for the Ninth Circuit held in an unpublished opinion Dec. 12.
The class would include the owners of almost 70,000 model year 2015 to 2017 trucks sold in California during the class period. The average manufacturer’s suggested retail price for the trucks was $45,500.
