A consumer suit alleging for-profit college Sullivan University System Inc. misled students with false employment statistics won’t proceed as a class action, a Kentucky appeals court affirmed Feb. 1.
The lead plaintiffs didn’t provide evidence that all class members were induced to attend the school by its misrepresentations, Judge Jeff S. Taylor wrote for the Kentucky Court of Appeals in a 2–1 unpublished opinion.
The proposed class would have included hundreds or thousands of members, the plaintiffs alleged.
