Florida Car Dealership Wins Reversal of Class Status in Fee Suit

A consumer suit alleging a Florida car dealership overcharged title and registration fees shouldn’t have been certified as a class action, a Florida appeals court said June 20.

Lead plaintiff Timothy Parker didn’t explain how the overcharge was deceptive or unfair under state law, Judge Lori S. Rowe wrote for the Florida Court of Appeal, First District.

“Without a legally sufficient claim under the substantive law applicable to this case, the court could not determine whether Parker’s complaint satisfied the requirements of commonality, typicality, numerosity, and adequacy,” the court said.
