Barbecue restaurant chain Famous Dave’s is facing a new lawsuit that alleges it underpays its servers and bartenders.
Christopher Graham accuses the company in his Feb. 19 lawsuit of systematically failing to pay tipped workers minimum wage and overtime wages, in violation of federal and Maryland law. Graham has asked the U.S. District Court for the District of Maryland to certify his case as a class action.
The company allegedly made its employees clock out if they were approaching 40 hours in a workweek, but still required them to finish their work, without compensation, according to the complaint.
