Facebook to SCOTUS: Privacy Ruling Makes Three Circuit Splits (1)

Facebook Inc. wants the U.S. Supreme Court to review class status in a suit alleging its facial-recognition software violated an Illinois law by gathering and storing personal data without users’ consent.

The Ninth Circuit’s decision that the users have standing to sue and affirming class certification creates or deepens three separate circuit splits, Facebook said in its petition for review docketed Dec. 4.

The named plaintiffs admit that they suffered no harm from the alleged violations of the Illinois Biometric Information Privacy Act, the company argues.
