Facebook Seeks Full 9th Cir. Review in Face-Scanning Case

Facebook Inc. has asked the full Ninth Circuit to decide whether the site’s users may proceed as a class in a potentially multibillion-dollar suit alleging it collects photos without permission.

Full-court review “is urgently needed,” Facebook told the U.S. Court of Appeals for the Ninth Circuit.

A unanimous three-judge panel of the Ninth Circuit Aug. 8 affirmed a lower court’s ruling allowing the privacy suit to proceed as a class action on behalf of Illinois Facebook users going back to 2011 whose photos were tagged and collected in a company-controlled database.
