Experian Wage Settlement Smacks of Collusion, Court Says

Experian PLC and employees will have to renegotiate the terms of a settlement to resolve Fair Labor Standards Act and Arkansas minimum wage claims, a federal court said June 18.

Under the proposed deal, Experian would pay opt-in workers $40,000 and class counsel would get $33,000.

Judge P. K. Holmes III of the U.S. District Court for the Western District of Arkansas called the terms “problematic” and denied approval.

The $40,000 payment to 138 workers who opted in to the certified collective action was calculated by estimating 4.13 minutes per day of uncompensated work for each worker.
