Ex-Tyson Worker’s Wage Collective Narrowed to Arkansas Facility

A former Tyson production supervisor may pursue a wage-and-hour suit only for other workers at his facility after a federal judge in Arkansas nixed his bid for a nationwide collective.

Anthony Freeman accuses Tyson Foods Inc. and Tyson Poultry Inc. of misclassifying him and other US production supervisors as exempt from Fair Labor Standards Act hourly wage and overtime protections. Other workers from the Pine Bluff, Ark., facility may join his suit, but the court won’t certify a nationwide collective or a state-law class, the US District Court for the Western District of Arkansas said.
