Alacer Corp. shed proposed nationwide class claims in a suit alleging it tricked consumers about how many vitamin C supplements make up a dose, when a federal court in California limited the scope to consumers in that state.
Jeffrey Cimoli alleged he relied on the front label of Emergen-C gummies, which said the product contains “750 mg Vitamin C” and “45 Gummies.” Based on these representations, Cimoli believed the bottle contained 45 Gummies, each containing 750 mg of Vitamin C, when three Gummies were required to obtain the 750 mg indicated.
