A beverage manufacturer facing pay frequency claims failed to convince a federal judge that the New York law mandating weekly wages for manual workers lacks a private right to sue.
The Best Bev LLC worker convinced the US District Court for the Northern District of New York to follow the majority of federal courts to consider the state law—and conflicting opinions from two quadrants of the state’s intermediate-level appellate court—and find a private right of action. The worker also has standing to pursue claims for inaccurate wage statements and missing wage notices, Judge Anthony J. Brindisi said Thursday.
