DOJ Renews Support for Overturning Qualcomm Class Antitrust Suit

A class action accusing Qualcomm Inc. of anticompetitive conduct should be overturned because it’s based on an antitrust theory that was recently thrown out by an appeals court, the Justice Department said.

The class action’s antitrust allegations can’t stand on their own even if the class suit is based off of California antitrust law and not federal law, Michael Murray, a deputy assistant attorney general within the DOJ’s antitrust division, said Tuesday in a letter to the U.S. Court of Appeals for the Ninth Circuit.
