DirecTV Stuck With Certified Class in Robocall Lawsuit

DirecTV LLC must face a certified class of consumers who allege it directed debt collection companies to make unwanted robocalls.

The U.S. Court of Appeals for the Ninth Circuit declined June 3 to review a lower court’s grant of class certification. The lower court found individualized questions of consent to receive the calls won’t overwhelm common questions.

Jenny Brown sued the collection companies and DirecTV under the Telephone Consumer Protection Act, alleging she received automated calls on her cell phone made on DirecTV’s behalf. She was never a DirecTV customer.
