CVS Defeats Claims It Gave Wrong RSV Vaccine to Pregnant Women

A woman alleging CVS Pharmacy Inc. administered a vaccine that wasn’t approved for pregnant individuals lacked standing for her consumer protection claims, a federal court said dismissing the proposed class action.

The plaintiff brought consumer protection claims under California laws, but didn’t specifically state what injury or harm she experienced, the US District Court for the Central District of California said Monday. The plaintiff said she suffered damage, but “these allegations are insufficient for Article III standing, let alone” the showing of actual harm for her consumer protection claims, Judge Dolly M. Gee said.
