Cutter Natural Mosquito Repellent Maker Beats Marketing Suit

United Industries Corp. defeated a proposed class suit alleging it deceptively labeled Cutter Natural Insect Repellent, as a federal judge in New York said the plaintiff failed to show the representation that the product “repels mosquitoes for hours” was false.

If there were evidence that the product worked for no one, the statement would mislead a reasonable consumer as to its efficacy, but New Yorker Nicholas Parker didn’t offer such evidence, the U.S. District Court for the Southern District of New York said Tuesday.
