Comcast Corp. won’t face class action claims that it conceals fees from subscribers because fact finding will be necessary for each individual plaintiff, the Northern District of California said.
The named plaintiffs allege they saw advertisements showing a base price that didn’t include the broadcast TV fees and regional sports fees.
Class treatment isn’t appropriate because it will be necessary to determine for each plaintiff whether Comcast explained that the fees would be charged on top of the monthly subscription rate, the U.S. District Court for the Northern District of California ruled July 16.
