A $2.8 million settlement for Colourpop Cosmetics to resolve Telephone Consumer Protection Act class action claims over unwanted text messages has been granted final approval by the U.S. District Court for the Southern District of Florida.
Judge Rodolfo A. Ruiz II, however, denied class counsel’s request for a $5,000 service award to class representative Anita Jairam.
The court didn’t find the award disproportionate to the class fund and “readily” concluded there was no fraud or collusion behind the settlement. Ruiz was required to deny the award, however, following the U.S. Court of Appeals for the Eleventh Circuit’s Sept. 17 decision ...
