Cartridge World North America LLC must face a certified class action for allegedly sending unsolicited fax advertisements, a federal court ruled.
“There was a common course of conduct by defendant which resulted in the same injury to every member of the proposed class,” Judge Christopher A. Boyko wrote for the U.S. District Court for the Northern District of Ohio July 30.
The class includes over 8,500 fax recipients, the court said. The Telephone Consumer Protection Act provides for damages of between $500 and $1,500 per violation.
