Cincinnati Credit Union Beats Mortgage Kickback Suit, for Now

Emery Federal Credit Union doesn’t have to face claims that it conspired with a title company to fix mortgage settlement service prices, but the homeowner plaintiffs can refile the proposed class action to show its claims were timely, an Ohio federal judge ruled.

The lawsuit accuses Emery of referring its residential mortgage customers to nonparty All Star Title Inc.—which has been implicated in similar alleged rackets before—in exchange for kickbacks. It was filed in the U.S. District Court for the Southern District of Ohio.
