Checkers $3.4 Million Spam Class Settlement Clears First Hurdle

Checkers Drive-In Restaurants Inc. will pay $3.4 million to resolve allegations it sent text advertisements to customers who had revoked their consent under a class settlement that won preliminary approval May 28.

The settlement covers the Telephone Consumer Protection Act claims of over 7,500 consumers who attempted to unsubscribe from Checkers text messages. Each class member who submits a valid claim will get up to $450.

Class counsel will seek up to 30 percent of the fund in attorneys’ fees and up to $15,000 in costs.
