Capital One’s $13 Million ATM Fee Settlement Receives Final Nod

Capital One will pay $13 million to resolve class claims over the fees charged to customers for balance inquiries made at out-of-network ATMs, after the U.S. District Court for the Southern District of California gave the settlement its final approval.

Judge Jeffrey T. Miller also signed off on an award of $3.9 million for attorneys’ fees, plus $15,585 for expenses, to class counsel Carlson Lynch LLP and Kaliel PLLC. Class representatives Jacob Figueroa and Mary Jackson will each receive $10,000 incentive awards.

The settlement represents 33% of the $39 million in estimated total damages, the Thursday ruling said
