Capital One’s $13 Million ATM Fee Settlement Gets Early Approval

A $13 million proposed class settlement to resolve allegations that Capital One wrongfully charged customers for some ATM balance inquiries has received the U.S. District Court for the Southern District of California’s preliminary approval.

The proposed settlement would allow an award of up to $3.9 million, or 30% of the fund, to class counsel, according to Judge Jeffrey T. Miller’s order.

Accounting for fees, costs of administration, and class representative’s incentive awards, an estimated $8.2 million would remain for class members’ claims.
