Capital One $13 Million ATM Fee Settlement Up for Final Approval

Capital One banking customers want a California federal court to give final approval to a $13 million class settlement to resolve allegations that it impermissibly charged separate fees for out-of-network ATM balance inquiries made during cash withdrawals.

The motion for final approval, filed in the U.S. District Court for the Southern District of California, said no one objected to the preliminarily approved settlement and only 39 of the over 1.6 million settlement class members opted-out.
