California Ice Cream Shop Suit Remanded, Misses CAFA Minimum

A proposed wage and hour class action against Salt & Straw LLP will make its claims in California state court, after a federal judge determined the ice cream shop’s estimate of the amount in controversy was inflated.

Hourly, non-exempt workers at Salt & Straw alleged nine causes of action under California’s Labor Code, and a tenth cause of action under the state’s Unfair Competition Law. The company failed to pay overtime wages, meal and rest period premiums, and denied final wages, among other things, the class said.
