First Student Inc. won a bid to make bus drivers who say it failed to pay them for all work hours go through the collective action process again under a new Sixth Circuit standard.
The appellate court’s May ruling in an unrelated case changed how courts within the circuit must manage Fair Labor Standards Act collectives and did away with the “concept of ‘conditional certification,’” so the workers need to make their case for group treatment again under the new, higher standard, the US District Court for the Northern District of Ohio said Friday.
