Brooks Brothers Racks Up Payment Card Data Breach Dismissal Win

The breach of credit card numbers and customer names at Brooks Brothers Group Inc. wasn’t sufficient to create a future risk of identity theft, a federal judge ruled.

The sensitivity of stolen data and the circumstances surrounding a breach are guides for a court to decide whether plaintiffs can continue with data breach actions, Judge Dolly Gee of the U.S. District Court for the Central District of California wrote.
